1. Acceptance of Terms

By accessing this website, submitting an inquiry or application, creating an account, enrolling, making a payment, or using UTA services, you agree to these Terms and Conditions and the documents incorporated by reference. If you do not agree, do not use the affected services.

2. About Unix Training Academy

Unix Training Academy provides technology education, practical training, laboratories, workshops, coaching, and related student services. Program availability, schedules, delivery methods, tuition, curriculum, instructors, tools, and prerequisites may change.

3. Eligibility and Age

You must provide accurate information and have legal capacity to enter an agreement. Participants under 18 may be required to obtain consent and payment authorization from a parent or legal guardian. The website and services are not directed to children under 13.

4. Applications and Admission

• Submitting an application does not guarantee admission, placement in a particular cohort, or program availability.
• UTA may review prerequisites, readiness, technical requirements, scheduling, payment status, and program fit.
• UTA may request additional information before accepting enrollment.
• Applicants must provide complete and truthful information.
• Admission may be denied or revoked for material misrepresentation, misconduct, nonpayment, or failure to satisfy program requirements.

5. Program Information

Program pages describe current intended content and structure, but dates, schedules, tools, vendors, projects, instructors, delivery methods, and curriculum may be revised for operational, educational, technical, safety, or legal reasons. UTA will make reasonable efforts to communicate material changes affecting enrolled students.

6. Tuition, Deposits and Payment Plans

• Current tuition and payment options are listed on the applicable program and payment pages or in the enrollment agreement.
• A $500 enrollment deposit may be required for an installment plan and is credited toward tuition.
• The deposit is not an additional fee above stated tuition unless a separate charge is clearly disclosed.
• Payment plans change payment timing but do not automatically reduce the total tuition obligation.
• Students must meet the due dates in the signed payment schedule.
• Payment processing may be performed by a third-party provider whose terms also apply.

Do not submit payment through an outdated or unverified link. Contact admissions when instructions are unclear.

7. Cancellations, Withdrawals and Refunds

Cancellations, withdrawals, transfers, deferrals, refunds, and program discontinuations are governed by the Cancellation, Withdrawal and Refund Policy, the signed enrollment agreement, payment schedule, and applicable requirements. A missed payment does not automatically constitute a written withdrawal request.

8. Student Responsibilities

• Attend scheduled sessions and participate professionally.
• Complete assignments, laboratories, projects, and practice activities.
• Maintain suitable internet access and a compatible computer.
• Protect accounts, passwords, credentials, API keys, and cloud resources.
• Follow instructor directions, security practices, and acceptable-use rules.
• Back up personal work where appropriate.
• Pay tuition and approved charges by required dates.
• Promptly report contact changes, absences, emergencies, or withdrawal.

9. Acceptable Use

You may not use UTA systems, laboratories, accounts, materials, or services to:

• Access systems or data without authorization.
• Distribute malware, conduct attacks, evade security controls, or engage in unlawful surveillance.
• Harass, threaten, discriminate against, or impersonate another person.
• Share paid recordings, credentials, licensed software, or restricted materials.
• Interfere with classes, systems, instructors, students, or service providers.
• Use cloud resources for cryptocurrency mining, prohibited content, or unauthorized commercial activity.
• Submit plagiarized work or misrepresent another person’s work as your own.

UTA may suspend access while investigating suspected misuse and may terminate access for serious or repeated violations.

10. Intellectual Property

UTA and its licensors retain rights in curriculum, recordings, slides, workbooks, laboratories, assessments, branding, website content, and instructional materials. Unless written permission states otherwise, enrolled students receive a limited, personal, nonexclusive, nontransferable license to use provided materials for their own learning during the authorized access period.

You may not reproduce, sell, publish, upload, distribute, teach from, sublicense, or commercially exploit UTA materials without prior written permission.

Students retain ownership of original work they create, subject to third-party licenses and limited permission reasonably necessary for UTA to review, store, assess, and administer submitted work.

11. Class Recordings and Participation

Live online sessions may be recorded for instructional, quality, attendance, or administrative purposes. Students should avoid sharing sensitive personal information during recorded sessions. Recording or redistributing a class by a student without written permission is prohibited.

12. Third-Party Platforms and Services

Programs may use third-party cloud providers, code repositories, video-conferencing tools, payment processors, certification vendors, software platforms, and learning systems. Their availability, terms, privacy practices, fees, and technical requirements are controlled by those providers. UTA is not responsible for a third party’s independent interruption, policy change, security incident, or account decision.

13. Certification, Employment and Career Outcomes

Training may support preparation for certifications or employment-related skills, but UTA does not administer third-party examinations unless expressly stated. UTA does not guarantee certification, examination results, employment, interviews, placement, promotion, salary, income, or acceptance by an employer, school, agency, or certification provider.

Outcomes depend on many factors outside UTA’s control, including effort, attendance, experience, market conditions, location, work authorization, interview performance, and employer decisions.

14. Employer and Brand References

Company, agency, product, and certification names belong to their respective owners. References do not imply sponsorship, endorsement, partnership, or affiliation unless expressly stated in writing.

15. Website Availability and Accuracy

We aim to keep the website available and accurate but do not guarantee uninterrupted operation or error-free content. We may correct errors, update pages, suspend functionality, or perform maintenance without prior notice. Contact admissions to confirm current tuition, dates, prerequisites, schedules, and payment instructions.

16. Disclaimers

To the extent permitted by law, the website and general informational content are provided “as is” and “as available.” Nothing on the website constitutes legal, tax, financial, medical, immigration, or employment advice. Nothing in these terms waives mandatory consumer rights.

17. Limitation of Liability

To the extent permitted by law, UTA will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use, third-party services, lost data, lost opportunities, or service interruptions. Any limitation does not apply where prohibited by law or to liability that cannot legally be limited.

18. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful conduct, unauthorized system use, infringement of another person’s rights, or material violation of these terms.

19. Suspension and Termination

UTA may suspend or terminate access for nonpayment, security concerns, misconduct, academic dishonesty, harassment, unlawful activity, material misrepresentation, or serious or repeated violation of these terms. Suspension or termination does not automatically eliminate tuition already earned or obligations established under the enrollment agreement and refund policy.

20. Privacy

Our collection and use of personal information are described in the Privacy Policy.

21. Governing Law and Venue

These website terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where another law must apply. Subject to mandatory legal rights, disputes concerning these website terms may be brought in a court of competent jurisdiction serving Harris County, Texas.

22. Changes to These Terms

We may revise these terms when services, technology, policies, or legal requirements change. Updated terms will be posted with a revised effective date. Changes to an existing student’s financial or enrollment obligations will be handled under the signed enrollment agreement and applicable requirements rather than solely through a website update.

23. Severability and No Waiver

If a provision is found unenforceable, the remaining provisions will continue to the extent legally permitted. Failure to enforce a provision on one occasion does not waive the right to enforce it later.

24. Entire Agreement

For general website use, these terms and incorporated policies form the agreement concerning that use. For enrolled students, the signed enrollment agreement, payment schedule, refund policy, program documents, and applicable policies form the more specific agreement and control over inconsistent general website language.
